employment-based immigrant visas and imposing fees for
immigration services for intracompany transferees. I apologize for
the delay in my reply, but I appreciate hearing from you and I
welcome the opportunity to respond.
I agree that the U.S. government should recapture unused
employment-based immigrant visas and impose immigration service
fees for those visas. As you may know, the United States Senate
version of the Deficit Reduction Act of 2005, S. 1932, included a
provision that would recapture up to 30,000 H-1B visas that had not
been issued in prior years. Also, S. 1932 would impose an additional
$500 fee to obtain these recaptured visas. These provisions were not
included in the House-passed version of the Deficit Reduction Act of
2005, H.R. 4241. Unfortunately, the Conference Committee, which
was responsible for resolving the differences between the House and
Senate versions of the bill, did not include this provision in the
final
version of S. 1932. The final version of S. 1932 passed in the House
by a vote of 216-214 on February 1, 2006. President Bush signed this
bill into law on February 8, 2006.
Please be assured that I will keep our shared support for
recapturing unused employment-based visas and imposing fees for
immigration services for these visas very much in mind as Congress
considers immigration issues.

Hello guys,
Need little advice from you guys.
My wife is having her citizenship interview and oath ceremony on April 30th.
My AOS Documents are almost ready and i am just waiting for her to become US Citizen. I just need her Naturalization certificate which i can attach with my I-130 application as proof of her citizenship.
after she become citizen, should i wait for a week or 2, before i send my AOS application to USCIS or just send it right away.??? if i send my application on the same day she become citizen........does that gonna create any problem for my AOS case ???

I have been waiting for the hard copy..so my Hr called Dol and asked whether they have mailed. The Dol officer sent the Cover letter by email (first page of whole approved package) to company HR showing the certification . She also told HR that cover letter was enough for I140 filing.
Is it true? Please let me know.

This is printed in the I-140 instructions(page 3):
General Evidence.
Labor certification. Petitions for certain classifications must be filed with a certification from the U.S. Department of Labor.
Copies.
If these instructions state that a copy of a document may be filed with this petition and you choose to send us the original, we may keep that original for our records. Copies may be submitted of all documentation with the exception of the Labor Certification which must be submitted in the original.

If the company is moving within the same county then no issues.
If it's moving to a different state (or) to a different county within the same state, then refer the following thread

Remember, the prevailing wage differs from county to county even within the same state.
How about if the company moves with in the same state but different county. My company is moving to a bigger facility as we have outgrown the current facility. I have applied for I-485 on July 3rd and my I-140 is already approved.
Seeing that under AC21, they give flexibility to move to a different employer and different state, I think the law would be flexible enough to accomodate moving of the work location within the same state with same employer.

Hi,
I am also in the same scenario. Filing I-140 and I-485 concurrently. My company's immigration attorney said that while filing for I-140 and I-485 concurrently, we can have the I-140 done in premium processing. And that is how they are filing for me now

I was in united states for 5 years and 2 months on H1-B visa. I did not apply for green card during my stay and had to return to India in Aug'2008 due to personal reasons. I want to find out if I am eligible for applyng H1 in this year's quota through same employer with whom I had earlier H1.
Here is my situation -
1. My H1-B petition is valid till 12th July 2009. My passport is not stamped to reflect this date.
2. I came back to India for good on 31st August 2008.
3. If I go back to US before 12th July, I will only get extension for remaining 10 months (as I was in us for 5 years and 2 months). But I want to go for couple of years, so have to go on new visa after completion of 1 year in India.

Hello Gurus,
Here is my situation and I really appreciate your advice:
I have filed my I-485, EAD, and AP thru my employer (consulting company) in EB3 category. I have received my EAD and AP but i havent invoked AC21.
I also have approved labor (PD--01/2006), and approved I-140 in EB2 category thru my client's company.
Since, EB3 category is not going anywhere, I am thinking of filing another I-485 thru my client in EB2 category.
1) Is it possible for me to file second I-485 in EB2 category while first I-485 is waiting for approval?
2) Can i port my EB3 PD (12/2003) while filing 2nd I-485 thru client?

No need to file 2nd I-485.
Just update your existing I-485 with 2nd I-140 and claim earlier PD. You can claim PD with EB2.
Your lawyer should be able to do that.

No need to file 2nd I-485.

For 485 you do indeed need to be in the US (for yoiu adjust status, you need to be in some status in the US). However for I-140 you need not be in the US. Can you point to any law or any link on any forum that says you need to be present for filing the I-140?
The complete GC process can be done without ever entering the US (do LC, file I-140, then do Consular processing for the final stage)

I was working on H1B from Sep 2002 till Jan 2006 and then converted to H4 based on my husband's H1B. No green card was started for my H1B. My husbnad's GC is in progress, but not even the labor is cleared as of now. I have been in the US on H visa (either H4 or H1B) starting from April 27'2002. Hence when my H1B (the second extension after 3 yrs) came back in 2005, it had an expiration date of April 26 2008 (allotting 6 yrs of H visa).
I would like to apply for jobs next year, but I understand the earliest I can start is Oct 2007, if I get an H1B sponsorship. In this event, what happens after April 2008, do I have to leave the country, or is it possible that the company that hires me starts a GC process for me in October 2007, but still my labor wouldnt have been pending for at least 1 yr, to get me an extension.
My husband is in his 8th year of H1B and I have a H4 based on that. Pl let me know how my H1B clock would work. I greatly appreciate your time

I want to transfer from H1B to F1.I came to US as a F1 and graduated in march 08.I got my H1B on oct 08.But now i want to transfer to F1 again and i had my visa till 2011. I had following doubts and please help me.
1) I heard that i can transfer to F1 from H1B without canceling(but deactivating H1B) is it true.

Interview Date - 13-Feb-2009
Purpose - H1B Visa Stamping(VISA Approval in 2008 before had F1 Visa)
Interview - VO Asked me few Questions and then asked me to show your company's Wages report and your consultacy and client where u worked agreement letter. I have given him both the docs. and Vo kept with him and gave me 221G Yellow letter which mentioned your docs. are in administrative processing and didn't mentioned any time frame.
After my Employer and i frequently sent emails and faxes to mumbai consulate but no response yet.
Anybody Knows what i have to do. Please advice me further .

Normally at the POE they scan the visa page to get the info. I think just the page being damp wouldn't affect the machine reading. But if you are so concerned you can call the nearest consulate in your home country, and inquire about it.

I am a Canadian PR, went to visit last week. I don't live near the border so took a rental car. Nothing particular was asked Canadian side.
