Like I said....I messed this one up and really had no intention of over-exposing it.
You think it would be better if I darken it? Hmmmm. I'll give it a try. I was looking at it and thinking that the really bright highlights gave a sense of heat.

Hi ,
I was convicted of petty larceny in NY. I was convicted of disorderly conduct PENEL CODE 240.20 on 05/25/2006 in NEW YORK . The actual arraignment charges applied were 155.25.165.40.
I performed 6 days of community service. Paid some $75. After a 1 year (5-26-2007) the charges were expunged. I have disposition letter from the NY court.
When I applied for my green card in July 2006 , in the I-485 / green card file I revealed that I was charged, convicted and arrested and my charges were expunged. I got my green card in August 2007 on the bases of VAWA (Violence against women act).
Now, I have been living in Maryland for the last 3 years.(Since September 2007)
I have applied for neutralization.
I am scared that I shall not be deported or citizenship should not be denied because of my conviction which is disposed almost 4 years old.
I have no charges against me after that incident.
I am filing my tax returns every year.
Do you think I can still be denied the citizenship? Or I can be deported ?
I would appreciate your response.

I am assuming your wife is H4? H4 to F1 shouldnt be a problem, this is the same path I took years ago before becoming H1.
There is only one issue I can think of and that is travelling outside the country. She might not be issued an F1 visa stamp at a consulate for travel outside the country since her H4 was based on yours which now has immigrant intent since you applied for PERM (LCA and I-140). The consulate will probably not believe she has non-immigrant intent. She would have to stay in the country until she changed to H1 and got that stamped, or until you get AP for both of you. But if you have no plans to leave the country I dont see that as an issue. Best to consult a proper immigration attorney since all I can tell you is my experience.

How about clearing the backlogs in the employment based system? We are contributing to the wealth of the company and the economy but our futures are in limbo and the best years of our careers are wasted worrying about a green card!
Not surprisingly, according to the most recent State Department Visa bulletin, the EB-1 category is one of the only employment-based category without a waiting list.
Does that not indicate a problem that needs to be fixed instead of ignored as you have done Philip Wolgin?

I applied my I-140 in february, 2007. In their system it's showing that it'd been received in FEb 8, 2007. and the case is still pending. As a EB3 from bangladesh when can i expect the approval. Lots of applications those were sent after mine have already been approved. I didn't receive any RFE or anything till now. Can anyone please help me with the update....

I am a B.COM and AICWA. I have also completed CA-Inter. I have totally 12 years of experience out of which 7 years in IT and 5 years Non-IT. I am currently working as Program Manager. My Labour is approved. My company is trying to get a evaluation done.
Would there be any issues when concurrently filing for I-140 and I-1485 with regard to the Education Evaluation.

Co. B can file the PERM at any time, but ideally one year before the current H-1B expires, even if that is 8+ years into your H-1B status. Provided that you have a PERM on file 365 days before the end of your H-1B status, the company can extend again based on that PERM #2. The filing does not have to be before the end of your 6th year.

I do not want to renew the advanced payroll, since I do not foresee travel within the next 18 months overseas. Is there a way I can skip the renewal this time around (1-year extension) and renew it the next time? If there is an emergency, I can still go to India and have the Visa-stamped since we have a valid H1/H4 right?

And you could be denied visa for no fault of yours. It happened to my wife and it took 3 months for the consulate to get the clearance. So think about it. Personally for me AP is a very important document it allows you to travel in case of an emergency.
